Notes for ALLAN M'YL VEYNE by Kimberly Egan:

Frank McElvain reports that the genealogist, Gustave Anjou namesthewifeofALAN M'YL VEYNE as Marian Fergoussone. She wasmentionedwithA1lan'sdaughter in law Janet Corrie in the register of theGreat SealMay30,1530.

These were particularly violent times, as indicated in thePBGR,June18,1526

' Alan Makilvane and ilk and other filled forreasonableslaughterofUnquhile (the late) Cornelius de Machan. Also MartinKennedyandGilbertMakilwraith were fined.' It seems that Alan, Gilbert,theEarlofCassilus and 233 others were involved in theslaughter.TheProtocolBook, January 2, 1530 suggests that Alan M'YlveyneofGrimmetgave bondfor Gilbert Kennedy, and so he was released frompenaltyonpromise ofgood behavior .

According to the Scottish Record Society Publication, Vol.28-34'AllanMakilvene, Laird of Grimmet, along with Thomas CorryofKelwood,DavidCrawford of Keirs, and others, was fined 100 pounds fornotenteringhisfriend, Gilbert Kennedy for participating in theslaughterofRobertCampbell of Lochfurgus, Alexander Kirkwood, andPatrickWilsone.RobertCampbell, having a short time before killed the oldEarlofCassilis,father to said Gilbert Kennedy. Done July 28, 1528attheJustice Court,held at Sterling

In the Charters of Crossraguel, page 42, 1528 is this'ThomasCorryofKelwood, Ayrshire, and others, including Alan Makilvane,LairdofGrumet,were fined 100 Pounds each for not entering Barganyfortheslaughter ofthe young Laird of Attiquane. According to DarrelIwerks,Thepossessionof Grimmet was turned over to Alan M'YlveynewhenGilbertreachedadvanced years. This view is supported by Jean Moore,who cites the PBGR:

0#1042 'Instrument narrating that Al1an M'Y1vene promisedtorelieveandkeep scathless Sir John Kennedy, Chaplain, and JohnCampbell,TutorofSkeldoun, at the hands of Gilbert M'Y1vene ofGrumet,concerningcertainthings committed to Gilbert by the said Allan,accordingto anagreementand communication verbally recited for the time.Done intheTolbooth ofAir, August 25, 1529. Witnesses, Gilbert~KennedyofKirktnichale, JohnKennedy, Alexander Mur and SirJohnCampbell,Chaplain.' o

#1043 'Instrument narrating that Sir John Kennedy, prebendaryofMayboleandJohn Campbell in Over Skeldoune, became suretiesandcautioners forAllanM'Ylvene that he shall do and fulfill allthingscommunicated inwordbetween him and Gilbert M'Ylvene, his father,namelythat he shallmakeGilbert his assignee in and to the fivemerk landofAttiquin forGilbert'slife-time, and that within twenty-four hours after Allan shall obtain thenon-entry of the lands under thepainof1000 merks and then he shall givesecurity to Gilbert of thelandsforlife, Gilbert paying an annual rent toAllan ...(the writ istoodefacedto get details).' Same date and witness asabove. Thedictionarygivesthe definition of prebendary as 'a person, as acanon, whoreceivesastated income from the revenues of a cathedral.

0# 1044 is the instrument quoted earlier in which GilbertKennedyasksthatthe above agreement not affect his nephew's rights inthelandsofAttiquin.

0# 1045 -'Instrument narrating that GilbertM'Ylvene,cornpearingbeforesaid Charles Campbell, sheriff of Air in thePart,confessed hehadoccupied and intromitted with the lands ofGrommetandAttiquin,extending to twelve-rnerk lands for the space ofXLVquinque(45) yearsby past, and on being required to produce his sasineofthelands, if hehas any, he declared that he had not for thetimeanyevidence toproduce.' Same date and witnesses.

0# 1047.- 'Instrument narrating that Allan M'Ylvene, havingthenon-entryofthe lands of Grunnnete, in terms of letters from thekingunder theprivyseal to said A11an, made and constituted GilbertM'Ylvene,hisfather, hislawful assignee in and to the fivemerk landsofAttiquin,with pertinents,namely the four-merk lands he now inhabitsandthat merklands of Gerygrun,inhabited by Nevin M'Clymyn, for lifetime,giving himpower to intromitwith, labour let and set the landsandreceive therents, transferring allright and claim from A1lan andhisheirs and toGilbert and his heirs, andthis because of paternallove,special favorand that he may freely obtainhis father's blessing,chieflybecause thesaid Gilbert is his father (patercarnalis) and now isaged,and if he(A1lan) shall prosecute the premises toextremity, they mayturntoGilbert's utmost loss and irreparable injury;for whichthingsGilbertshall pay yearly during his lifetime the sum oftwentyshillings.Thegranter binds himself to ratify what his assignee doesinthepremises,under obligation of all his goods. Done at Air 25August1529.

0# 1215 in the Gavin Ros records, is an 'InstrumentnarratingthatQuintonSchaw, compearing in the parish church of Air,asserted thathehadformerly been required by A11an M'Ylvene to compearthere andreceive82pounds for redemption of the lands and to see thelettersfulfilled inallpoints. A1lan refused to show said letters,asserting that the lands were redeemed by thosehavingthepower. Dated 10Nov. 1531 (See king's 1529 charter.) A1lan was listed as a juror onassize court in the bailliary ofCarrickin1532.

Air 25 August 1529

'Allan M'Ylvene, having the non-entry of the lands of Grummete,internsofletters from the king under the privy seal to saidAllan,madeandconstituted Gilbert M'Ylvene, his father, his lawfulassignee inandtothe fivemerk lands of Attiquin, with pertinents,namelythefour-merklands he now inhabits and that merk land ofGerygrum,inhabitedby NevinM'Clymyn, for life time, giving him power tointromitwith,labour letand set the lands and receive the rents,transferring allrightand claimfrom Allan and his heirs and to Gilbert andhis heirs, andthisbecauseof paternal love, special favor and that he mayfreelyobtainhisfather's blessing, chiefly because the said Gilbert ishisfather(patercarnalis) and now is aged, and if he (Allan)shallproisecutethepremises to exctremity, they may turn to Gilbert'sutmostlossandirresparable injury; for which things Gilbert shall payyearlyduringhislifetime the sum of twenty shillings. The granter bindshimselftoratifywhat his assignee does in the premises, under obligationof allhisgood'
