1. Biography Augustus R. Bennick was 45, his wife Sarah E., age 38, born NC,daughter Ida A., age 14, born SC, son John H., age 12, born TN,Elizabeth, age 9, born Arkansas, Harriett, age 7, Arkansas, son ClarkA., age 4, Arkansas, and daughter Winnie, age 1, born Texas. Therewas evidently a squabble over the desposition of the estate of HenryCansler. In the 13 October 1883 issue of the Newton Enterprise, P.A.Hoyle, the Clerk of the Superior Court of Catawba County posted alegal notice outlining the dispute between Henry's son Henry MartinCansler and Henry's daughter Sarah Bennick. Under the heading HENRYM.S. CANSLER & OTHERS VS. A.R. BENNICK & WIFE SALLY was written;Defendants A.R. Bennick and wife Sallie K. Bennick, are herebynotified that the Plaintiffs in the above stated case have institutedin this court a special proceeding to sell for petition, the landsdescribed in the complaint filed, in said cause, formerly belonging toHenry Cansler, dec'd, and other relief demanded in said complaintaccording to other allegations therein contained. Said defendants A.R.Bennick and wife Sallie E. Bennick, are, therefore, hereby notified tobe and appear before the undersigned clerk of the Superior Court ofsaid county of Catawba, at his office in Newton, on Friday the 14thday of December 1883, and answer said complaint of plaintiffs, whichis filed in said office, or plaintiffs will take judgement for therelief demanded in said complaint. P.A. Hoyle 11 October 1883. On 26 January 1884, the Newton Enterprise published the followingnotice: Henry, M.L. Cansler vs. A.r. Bennick By virtue of an order of Superior Court of Catawba county, made in theabove stated case, I will expose to public sale at the court house inNewton, on the last Monday in February 1884, the following describedlands lying and being in the county of Catawba adjoining the lands ofCharles Scronce, Solomon Hefner, Adline Jonas and others, being thelands of the late Henry Cansler, dec'd, containing about 200 acres,and another tract containing about 27 acres. Terms cash. R.J. Shipp,Commissioner A.R. Bennick died in Call, Texas and was buried in the KirbeyvilleCemetery. He was a member of the Orange Lodge of A.F. and A.M. and wasburied with Masonic honors by members of the Kirbyville Lodge. He wassurvived by seven children; Mrs. Lucy Moore, Robston, Mrs. IdaRussell, Huntsville, Mrs. Bessie Watson, Voth, Mrs. Vivian McKinzie ofStarks, Louisiana, Mrs. May Benson of Call, Texas. Augustus Bennick was the oldest of nine children born to Rev. PhilipJ. Bennick (1809-1872) and Susan A. Henkel (1815-) Both of his parentslived their entire lives in Catawba County. Augustus Bennick completedhis theology studies at Catawba Lutheran College in 1856. He joinedthe Methodist Church, and served on the Hickory circuit and othercircuits until the Civil war broke out. He was appointed chaplain ofthe 34th North Carolina Infantry, a position he held until theregiments surrender at Appomattox Court House in 1865. After the war,he lived in South Carolina, leaving there to live in Johnson City,Tennessee, where he was principal of an academy for four years. In1871, he moved to Batesville, Arkansas. His health deteriorated inArkansas, and he moved, in June 1876, to Burnet County, Texas. Hetaught school and served as an itinerant preacher there for the next20 years. Burnet County is about 75 miles northwest of Austin, Texas.He stopped teaching in 1909, and died in November 1925. He was amember of the Orange Lodge of A.F. and A.M., and was buried withmasonic honors by the Kirbyville lodge.
