Lewis County Herald Thursday, March 12, 1925 J. D. Beatty Dies after Long Illness J. D. Beatty died at his home on Trace Creek Tuesday morning at 5 A. M. after several months illness, age 60 years. Mr. Beatty is one of the best known citizens of the county, having served as deputy sheriff of this of this county for many years under Sheriff W. T. Plummer and resided here for a number of years. He was twice married, his first wife having died several years ago and he is survived by 8 children, six sons and two daughters as well as his prese wife and several step-children. He is also survived by one sister, Mrs. Sid Barnett of Trace Creek. The remains were laid to rest in the family burying ground near the family home on Trace Creek Wednesday. Funeral services conducted by Rev. Byron Webb of Hohenwald. Lewis County, TN February Term 1916 The State VS/Assault with intent to commit murder in First Degree James Beatty James Hill, Prosecutor Subpoena for the State James Hill, Josie Beatty, Acre Hinson, Dr. G.N. Springer, Babe Tharp. Witnesses sworn in open court and examined on this indictment before the Grand Jury February. Term 1916 B.P. Anderson Foreman Grand Jury Jno. L. Neely, Attorney General Josie Beatty VS/(??) Court of Lewis Co., Tenn. J.D. Beatty Decree This cause came on to be heard before the Honorable Douglas Wilke, Circuit Judge & etc. upon the bill and proconfessa heretofore entered, and the testimony of certain witnesses who were examined orally, and in open court; It appearing to the Court that the defendant had been Quilty of such cruel and inhumane treatment as rendered unsafe, and improper for her to long live and cohabit with him, or to be under his dominion-and control-a further appears to the Court that the defendant has offered such indignities to her person-as render her condition intolerable, and that she was forced to with draw from him. It is therefore ordered, adjudged, and decreed, that the bonds of matrimony now subsisting between the Complainant Josie Beaty, and defendant J.D. Beatty be dissolved, annulled, and for nothing held, and that she be restored to all the rights of an unmarried woman, and that complaina restored to the name of her first husband Sidney Beard. It is further ordered adjudged, and decreed that the defendant pay all the cost in th cause for which execution will issue against him. State VS/Assult with intent to commit murder in 1st degree James Beatty Come again the Attorney General for the State, and come again the defendant in his own proper person-and by his Attorneys, come again the Jury to-wit: Carl Spinkles, S.H. Grimes, Joe Loveless, John Campbell, Martin Hinson, J.A. Johnson, J.J. Stegal, and John Schwendeman, who, were heretofore swo this case, and who were on yesterday respited until Saturday Morning, come into open court in charge of their sworn officers, Jim Williams S.D. and George Rome S.D. retire to their room to consider of their verdict and after due consideration of cause, returned into open court and say that they are unable to agree upon a verdict. Thereupon it is ordered by the Court that said jury be discharged, and that a mistrial be entered in said case. State VS-904/Assult with intent to commit Murder James Beatty This day came the Attorney General for the State, and the defendant in proper person, and by his Attorney who, being arraigned on an indictment for assult with intent to commit Murder in the 1st degree, pleads not guilty to said charge, and for a trial puts himself upon his country, and the Att General doth thee same; Thereupon come a jury of good and lawful men, to-wit; Chiuk Trull, W.D. Workman, Clem McCollum, J.W. Campbell, Louis Mathis, Jno. Fain, W.G. Humphery, Lee Workman, Walter Wiley, Wesley Poore, Charley Brook, and George spears who, were sworn according to law to we and truly try the issues joined and a true verdict render according to the law and evidence, and who after hearing a part of the evidence, and the hour of adjournment having arrived, they are respited until tomorrow morning at 9:00 O'clock in the charge of Ed Akers, C.L.C. & George Hinson Dep. Shff. of Lewis County, who, were sworn according to take charge of said jury, and return them into open court tomorrow morning at 9:00 O'clock. Thereupon court adjourned until tomorrow morning at 9:00 O'clock. Douglas Wikle, Judge Friday Morning Feb. 15-1918 Court reconvened Friday Morning pursuant to adjournment. The Hon. Douglas Wikle, Judge present and presiding as of yesterday when the following proceedings were had to-wit: State VS-904/Asslt. with intent to commit Murder James Beatty Come the Attorney General for the State and the defendant in his own proper person and come again into open court in charge of their officer's the jury heretofore sworn in this case, and who on yesterday respited until Frid morning until 9:00 O'clock, and who after hearing all the evidence in t case, the argument of counsel, and the charge of the Court, retire to their room to consider of their verdict, and after due consideration of same return into open court, and do that they are unable to agree upon a verdict. Thereupon it is ordered by the court that the jury be discharged, and a mistrial be entered. Wednesday Morning, May 22, 1918 State VS-944/ Asslt. with intent to commit murder James Beatty This day come the Attorney General to represent the State, and the defendant in his own proper person, and by his Attorney's who being arraigned on an indictment for an Assult & etc. pleads quilty to the same, and begs the mercy of the court. Thereupon it is ordered adjudged, decreed by the Court, that the defendant pay a fine of $2.50, and all cost for which let execution issue. It is further ordered by the Court that in event the defendant fails and refuses to pay or secure said fine and cost that he be delivered to the keepers of the work house in whose custody he shall remain until by hard labor, he shall have worked out at the rates allowed by law the fine of $22.50, together with all costs in the cause.
