Der Schultheiß oder Schuldheiß (von althochdeutsch: sculdheizo, latinisiert (mlat.): scultetus) bezeichnete einen in vielen westgermanischen Rechten auftretenden Gerichtsbeamten, „der Schuld heischt“, d.h. der im Auftrag eines Herren (Landesherrn, Stadtherrn, Grundherrn) Abgaben einzieht oder Verpflichtungen auferlegt. Sprachliche Varianten des Schultheißes sind Schulte oder Schulze.

Der Schultheiß war meist Richter der niederen Gerichtsbarkeit. Im friesischen und fränkischen Recht war er ein Hilfsbeamter der Grafen, betraut mit der Einziehung von Geldern und der Vollstreckung von Urteilen, meist auch Hundertschaftsführer.
